Terminating an Employee – What Employers Need to Know

A thorough review of a company’s termination procedure (if any) should be reviewed prior to an employee’s termination.  

The termination of an employee is never easy. However, the failure to properly terminate an employee could be very costly. Below are a list of items that should be considered when terminating an employee: 

  • What type of employee is being terminated (at-will or an employee that has an employment contract); 
  • A review of federal and state laws regarding wrongful termination should be reviewed; 
  • Employers should have and review their pre-termination checklist prior to an employee’s termination;  
  • Severance pay, waivers and unemployment claims are all key considerations for an employee’s termination; and 
  • In today’s environment, post-termination workplace violence is always a concern.
