As we quickly move into 2023, Human Resources (HR) managers must be prepared for the challenges that lie ahead. Whether a business is a start-up or a Fortune 500 company, an HR compliance check is mandatory.
Compliance begins with recruiting. Below are some basic guidelines that HR should follow in the hiring and recruiting providers:
• Use non-discriminatory job descriptions. • Set guidelines for proper questions regarding salary or criminal records. • Do not ask questions regarding a candidate’s marital status, religion, sexual preference, citizenship, birthdate, or age. • Keep all application forms and interview evaluations in order to document reasons for rejecting a candidate in case of an EEOC claim is filed by a candidate that was turned down for a particular job. • Provide equal compensation for equal work (regardless of internal job descriptions) and ensure pay practices are compliant with state and federal guidelines.
HR compliance is no longer option. HR and hiring managers must continue to remain updated for laws that change on a local, state and national basis.
