Biography
Stuart J. Oberman is the founder and President of Oberman Law Firm. Mr. Oberman graduated from Urbana University and received his law degree from John Marshall Law School. Mr. Oberman has been practicing law for over 30 years, and before going into private practice, Mr. Oberman was in-house counsel for a Fortune 500 Company.
Mr. Oberman is highly regarded on a national basis in the area of healthcare law, which includes the formation of healthcare management companies, corporate business structures, mergers and acquisitions, regulatory compliance, advertising regulations, HIPAA, compliance, and employment law regulations that affect healthcare practices. In addition, Mr. Oberman’s expertise in the healthcare industry includes representing and advising clients regarding administrative/regulatory compliance matters that involve licensure applications, disciplinary investigations, Board complaints, credentialing and peer review, Medicare/Medicaid fraud and recoupment investigations, as well as State and Federal regulatory compliance investigations involving healthcare fraud and abuse law (Anti-Kickback Statute and the State Law), and risk management.
For areas regarding complex regulatory healthcare matters, Mr. Oberman represents clients on a national basis regarding practice areas that involve telehealth and telemedicine, including compliance of corporate structures, corporate practice of medicine, third-party reimbursement, contract negotiations, technology, healthcare fraud and abuse law (Anti-Kickback Statute and the State Law), professional liability risk management, federal and state regulations.
In the area of technology, Mr. Oberman routinely advises small start-ups to national companies regarding data security and privacy, technology licensing, intellectual property protection, copyright and trademarks, cyber security, internal risk assessment, licensing agreements, copyright and trademark‘s, end-user license agreements (EULA’s), master license agreements (MLA), SaaS models, and the Digital Millennium Copyright Act (DCMA), cloud computing agreements, joint development agreements, and custom software development agreements.
Mr. Oberman also represents local, regional, national and global clients in complex HR and employment law matters that include separation and severance agreements, workplace investigations, compensation audits, employment policy and practice review and audits, Title VII of the Civil Rights Act of 1964 (Title VII), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Fair Labor Standards Act (FLSA), the Family and Medical Leave Act (FMLA), whistleblower claims under the Occupational Safety and Health Act (OSHA) and the National Labor Relations Act (NLRA).
In addition, Mr. Oberman has a nationwide practice that focuses on corporate governance, fiduciary duty, trade secrets, unfair competition, covenants not to compete, trademark and copyright infringement, fraud, and deceptive trade practices, and other business-related matters.
Mr. Oberman also represents clients throughout the United States in a wide range of corporate practice areas, including mergers & acquisitions, partnership agreements, commercial real estate, entity formation, employment law, commercial leasing, intellectual property, and HIPAA/OSHA compliance.
Mr. Oberman is a national lecturer and has published articles in the U.S. and Canada.
